Product  & Services User Agreement

MichaelsGraphics.net is a service of The Rejuvenation Station, LLC (hereinafter referred to as TRS). The TRS Products & Services User Agreement (hereinafter referred to as the “Agreement”) outlined on this page contains the terms and conditions which apply to your purchase and/or use of any of the products and services that you purchase from TRS including, but not limited to graphics, videos, audio files, design services, copywriting services, books, CDs/DVDs, manuals, webinars and downloads (hereinafter referred to collectively as the “Products”).
 
By purchasing and using any Products from TRS, you are agreeing to be legally bound by the Agreement. If you do not agree with the terms and conditions of the Agreement, please do not purchase any of the Products offered by TRS. These terms may be updated from time to time without notice to you. You should review the MichaelsGraphics.net website periodically for changes to these terms.
 
THE PRODUCTS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES FOR A PARTICULAR PURPOSE. By purchasing the Products, you understand that TRS makes no warranty, guarantee, or prediction regarding any outcome from your use of the Products for any particular issue. You also understand that TRS accepts no responsibility or liability whatsoever for the use or misuse of any of the Products. Your use of the Products is AT YOUR OWN RISK. Success stories and financial results from the use of TRS Products are provided as examples and are not intended as guarantees. Your results when using the Products may vary and TRS shall not be liable for any damages or injury arising out of your access to, or inability to access, the Products. TRS disclaims any and all liability for direct, indirect, incidental, consequential, punitive and special or other damages, lost opportunities, lost profit or any other loss or damages of any kind.
 
By purchasing any of the Products offered by TRS, you knowingly, voluntarily, and intelligently assume all risks, including any adverse outcome that might result from your use of the Products. You agree to forever fully release, indemnify, and hold harmless, TRS, its owners, members, principals, staff members, employees, consultants, agents, representatives, and others associated with TRS, from any claim or liability whatsoever and for any damage or injury whether personal, financial, emotional, psychological or otherwise, which you arise at any time, out of or in relation to your use of the Products.
 
You agree and understand the Agreement is intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law and that if any portion hereof is held invalid, it is agreed that the balance of the Agreement shall continue in full force and effect. The Agreement sets forth the sole and entire understanding of the parties hereto relating to the subject matter hereof. Any and all matters in dispute between the parties to the Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of the State of North Carolina, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted.
